Each of the participating restaurants listed on the Site have become members of our network (the "Network") and adopted our wine reservation system. The Site interacts with participating restaurants to find available wines, to secure, change or cancel online wine reservations, and to confirm that reservations were honored. The Site passes pertinent information to individual participating restaurants as required to secure or cancel online wine reservations.
We may employ cookie technology to store and track information about the users of the Site. Cookies are a feature of web browser software that allows web servers to recognize the computer used to access a web site. Cookies are small pieces of data that are often stored by a user's web browser on the user's hard drive. Cookies can remember what information a user accesses on one web page to simplify subsequent interactions with that web site by the same user or to use the information to streamline the user's transactions on related web pages. This makes it easier for a user to move from web page to web page and to complete transactions over the Internet. Cookies should make your online experience easier and more personalized.
There are two kinds of cookies, session cookies and persistent cookies. A session cookie is a line of text that is stored temporarily in your computer's memory. We also may use cookies from time to time to measure your response to new aspects of the Site and/or e-mails in an effort to continually improve customer service and web site usability.

Some of our services, as well as certain portions and features of the Site, however, may not work correctly or will not work at all if your browser is set not to accept cookies.
The Site uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses cookies to help us to analyze how users use the Site. The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Site, compiling reports on web site activity for us and providing other services relating to web site activity and Internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Traffic Data is anonymous information that does not personally identify you. Traffic Data assists us to design and arrange our web pages in the user-friendliest manner and to continually improve our Site to better meet the needs of users.
We may use web beacons (small pieces of data that are embedded in images on the pages of web sites) and auditing software to track page views and entry and exit points to and from the Site. In addition, we may use web beacons, cookies, customized links and/or similar technologies to determine whether e-mail and/or electronic newsletters sent by us to Registered Users who have opted to receive e-mail and/or electronic newsletters from us have been opened and which links are clicked. The data collected will only be used in an aggregate form and will not contain any personally identifiable information.
In order for you to access certain services that we may offer via the Site or otherwise, we may require you to provide us with information that personally identifies you, such as your full name, telephone number and e-mail address ("Personal Information"). As an unregistered user, if you opt to receive marketing or promotional communications from us, you will be asked to provide your full name and e-mail address to which the requested information will be sent. If you choose to register with us (become a "Registered Member") in order to take advantage of our wine reservation services and other benefits, you will be asked to create a password and provide Personal Information, including the following: full name, primary telephone number, e-mail address and your United States city of residence. We may also ask for demographic information, such as your age, gender, preferences and interests.
You may choose not to provide us with any Personal Information. In such an event, you can still access and use much of the Site. You will not, however, be able to access services that we may offer or use those portions or features of the Site that require your Personal Information.
If you communicate with us by e-mail, or otherwise complete online forms, surveys, or the like, any information provided in such communication may be collected as Personal Information.
Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with legal process (such as a court order) or other legal requirements of any governmental authority; (b) protect our rights or property; (c) enforce our Site's User Agreement located at http://www.diderot.com/useragreement.php and incorporated herein by reference; (d) protect the interest of users of the Site, other than you, or any other person; and/or (e) operate or conduct maintenance and repair of our services or equipment, as authorized by law.
In general, we will only use Personal Information for the purpose for which such information was provided to us.
We may use your Personal Information for the following purposes: (1) to secure your wine reservation at the participating restaurant(s) that you have selected, by providing your name and telephone number to that restaurant; (2) to provide you with information about wine availability at participating restaurants; (3) to provide you with information about us, our programs and services and/or participating restaurants; (4) to provide services to which Registered Members are entitled to under our applicable terms and conditions of service contained in our User Agreement; (5) to produce aggregate statistical data for the improvement of services offered by us; (6) to provide you with wine information and/or recommendations based on your wine and restaurant reservation history; (7) to respond to your inquiries; (8) to offer you other products, programs or services that we believe may be of interest to you; and (9) for any other purposes related to those set forth above.
We may share Personal Information with participating restaurants at which you make wine reservations, as described in this Privacy Policy. We may also share your Personal Information with producers of the wines you reserved through our wine reservation services. Additionally, we may share Personal Information with third parties that provide services to us or to Registered Members through us.
We may use Traffic Data to analyze trends, administer the Site, track user's movement, and gather broad demographic information for aggregate use.
We may provide Traffic Data and/or other aggregate non-personally identifying information to third parties.
We may hire third parties to provide services on our behalf and Registered Members' support, such as handling and delivery of e-mail communications and newsletters, hosting our Site, or processing transactions. Agents and contractors of Diderot who have access to Personal Information are required to protect this information in a manner that is consistent with this Privacy Policy and not to use it for any purpose other than to carry out the services they are performing for Diderot.
Notwithstanding the foregoing, we may transfer, sell or assign information concerning this Site and your use of this Site, including without limitation, Personal Information, to third parties, as a result of the sale, merger, consolidation, change in control, transfer of substantial assets, reorganization or liquidation of Diderot.
When you make a wine reservation using the Site, your Personal Information is provided to the participating restaurant at which you made a wine reservation. A participating restaurant will also have access to your wine reservation history for the wines you reserve from that particular restaurant, if any (including the date(s) and time(s) of the reservation(s), the wine(s) reserved, the number of bottles reserved and whether or not the reservation(s) were honored).
Except as provided below, Wwe will only share the information specified above with the participating restaurant at which you have made wine reservations using the Site. Upon making a reservation with a participating restaurant, in addition to the information specified above, the participating restaurant will be able to access a list(s) of wines you have reserved at all participating restaurants (including information on the wines reserved, the date of the reservation, and the amount of wine reserved, but excluding the name of the restaurant at which the wines were reserved). Restaurants cannot access information pertaining to Registered Members' histories concerning other restaurants.
Participating restaurants in the Network primarily use information provided by us to secure the desired wine reservations.
The participating restaurants within the Network are separate businesses from Diderot. While we encourage them to comply with data protection requirements, we will not be responsible if the participating restaurants fail to comply with those requirements with respect to your information. Any complaints and/or inquiries regarding use of your information by a participating restaurant, or communications from a participating restaurant, should be addressed directly to the restaurant in question.
Restaurants within the Network may also have their own web sites. We are not responsible for how these restaurants may collect personally identifiable information through their own web sites. Please contact the appropriate restaurant regarding its web site's privacy policy and how it will access or use your personally identifiable information.
We send Registered Members automated service messages pertaining to upcoming or recent wine reservations, such as confirmations, reminders, and notifications of new cities, wines and restaurants added to the Network. While Registered Members cannot unsubscribe from all messages relating to our services, they may choose not to receive marketing or promotional communications from Diderot (other than automated service messages pertaining to their reservations).
Where users (as Registered Members or unregistered users) have opted to receive marketing or promotional communications from us, they may from time to time receive communications relating to special offers, wine recommendations and/or general information about wines. They may unsubscribe from our e-mail list at any time by following the directions provided in the e-mail communications, by replying to the marketing or promotional communications with "unsubscribe" in the subject line, or, in the case of Registered Members), by visiting "My Account" page on the Site and choosing to opt-out from receiving future marketing or promotional communications.
A Registered User may contact Diderot at any time to request that all Personal Information in Diderot's possession and control be deactivated, its membership terminated and that services be discontinued.
Once a Registered Member logs on to the Site, he/she can view his/her Personal Information stored by Diderot by clicking on the "My Account" link at the top of the page. In addition to being able to view recent wine reservation history, every Registered Member is also able to view and change the following Personal Information: name, e-mail address, password, telephone number, dining city, and whether that Registered Member would like to receive marketing or promotional communications from us.
This Site contains links to third-party web sites. These links are provided solely as a convenience to you and not as an endorsement by Diderot of the contents on such third-party web sites. We are not responsible for the privacy practices or content of linked third-party sites and do not make any warranty or representation regarding the content or accuracy of materials on such sites. Nor do we make any warranty or representation regarding, nor does it endorse, any linked third-party web sites or the information appearing thereon or any of the products or services described thereon. Links do not imply that Diderot or this Site sponsors, endorses, is affiliated or associated with, or is legally authorized to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links. If you decide to access linked third-party web sites, you do so at your own risk.
The Site has security measures in place intended to protect the loss, misuse and alteration of the information under our control. We use a multi-layer encryption algorithm, and take reasonable steps to safeguard Personal Information we collect from unauthorized access or disclosure and accidental loss, alteration or destruction.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, although we strive to protect your Personal Information, we cannot ensure or warrant the security of any information you transmit to us or from our online services, and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to prevent unauthorized access and ensure security on our systems.
We may change our Privacy Policy at any time by updating this posting. Changes to our Privacy Policy will be effective when posted. If at any point we decide to use Personal Information in a manner materially different from that stated at the time it was collected, we will notify users by e-mail at the last e-mail address that was provided to us. Users will have a choice as to whether or not we use their Personal Information in this different manner. Unless otherwise agreed, we will use Personal Information in accordance with the Privacy Policy under which the information was collected.
We are committed to protecting the on-line privacy of children. In accordance with the Children's On-line Privacy Protection Act, we will not knowingly collect any personally identifiable information from or provide any services to children under the age of 13.
By using the Site, you signify your assent to our Privacy Policy. If you do not agree with this Privacy Policy, please do not use our Site. Your continued use of this Site following posting of changes to these terms will mean you accept those changes.

Users who reside in California and have provided Personal Information to Diderot have the right to receive: (a) information identifying any third party to whom Diderot may have disclosed, within the past year, personal information pertaining to said user for that party's direct marketing purposes; and (b) a description of the categories of personal information disclosed. To obtain such information, please e-mail your request to CAPrivacy@diderot.com. This request may be made no more than once per calendar year. We reserve the right not to respond to requests submitted other than to the address specified in this paragraph.
